I agree that if I engage in any physical exercise or activity or use any part of CrossFit Best Life, I do so at my own risk.  This includes, but is not limited to, my use of the CrossFit Best Life facilities, parking and outdoor areas, and my participation in CrossFit Best Life programs.

I agree that I am voluntarily participating in these activities and assume any and all risk of any type of injury, illness, damage or loss to me, or my property that might result, including the contraction of any illness or medical condition, or any loss or theft of any personal property. I realize that I am subject to injury from physical activity and that no form of preplanning can remove all dangers to which I am exposing myself. I have been informed of the risks involved and choose to participate with full knowledge & understanding of such risks. I am physically fit and know of no medical or health reason why I should not participate in exercise, personal training, or in any other activities that will take place at CrossFit Best Life.   

I agree, on behalf of myself, my family members, and all guests (including personal representatives, heirs, executors, administrators, agents and assigns of each) to release and discharge The Fitness Nook, LLC (and their affiliates, employees, agents, representatives, successors, and assigns) from any and all claims or causes of action (known or unknown) occurring anywhere on  the the premises, arising through the use of the facilities, and  through the participation in CrossFit Best Life Classes, whether indoors or outdoors. 

I, my family members, (including personal representatives, heirs, executors, administrators, agents and assigns of each) hereby waive all claims, demands, and causes of action against The Fitness Nook, LLC (and their affiliates, employees, agents, representatives, successors, and assigns) regardless of whether the injury (including death) or loss was caused by the negligence of The Fitness Nook, LLC (and their affiliates, employees, agents, representatives, successors, and assigns).  

 I, my family members, and all guests (including personal representatives, heirs, executors, administrators, agents and assigns of each) further agree that if, despite this Waiver and Release, I or anyone on my behalf, makes a claim for any injury (including death) or loss to me, my family members, and all guests, I will indemnify, defend, and hold harmless The Fitness Nook, LLC (and their affiliates, employees, agents, representatives, successors, and assigns) from any such claim or law suit.  This includes reimbursing The Fitness Nook, LLC (and their affiliates, employees, agents, representatives, successors, and assigns) for all costs, expenses and attorneys fees incurred to defend any such claim or lawsuit. 

I hereby give permission to The Fitness Nook, LLC use my likeness, alone or with others, by means of photograph, video or other medium for use in promotional materials or publicity, without notice to me and with or without a caption that identifies me. I understand my likeness may appear in internal publications, promotional audio/visual presentations, or external publicity, including, without limitation, use on the CrossFit Best Life web site, newsletters, or other development or promotional materials.

 I acknowledge that I have carefully read this Waiver and Release and fully understand that it is a waiver and release of liability to full extent permitted by applicable law. I sign it of my own free will. I also understand that this contract is severable; in other words, if any part of it is held by a court of law to be unenforceable, the rest of it shall survive.

Members Declaration

Before signing this document, I have read, understand and hereby agree to the terms and conditions or membership as defined herein and know that it effects my legal rights.

Administration

Memberships are not refundable or transferable.

All membership, service, and goods payments will be processed through the PushPress member system.
All equipment must be disinfected and put back to original location after use.
Each member must respect other members and behave in an appropriate manner at all times. CrossFit Best Life staff reserves the right to rescind the rights of members not complying with the terms and conditions of membership.
All membership fees are due on or prior to the 1st of the month.

Memberships initiated mid-month will be prorated until the first full billing cycle.

Service Suspension/Termination

A member may voluntarily suspend their membership for a minimum of 30 days.

To suspend or terminate a membership, the member must notify CrossFit Best Life staff in writing of their intent no less than 30 days prior to the next scheduled billing.

Membership will be suspended if payment is not received on or before the 1st of the month, membership will be reactivated when member's account has been made current.

Prepaid personal training sessions have a 90-day expiration window. Sessions not used within 90 days of purchase will be forfeited.

Class Schedule

Class schedules are provided through our facility’s PushPress system and are available in your mobile member app, online portal, and www.crossfitbestlife.com 

Class schedules will be posted on a weekly basis and are subject to change.

Facility Closure

CrossFit Best Life reserves the right to close the facility at any time. Unlimited memberships will be discounted 15% for each week (7 days) of closure. Discounts will not be administered for facility closures less than 7-days.

Upon facility closure, CrossFit Best Life may provide supplemental resources to continue the CrossFit methodology at the members discretion. 

CrossFit Best Life may notify members of facility closures within 21 days of event but this is not guaranteed.

Restroom Policy

Restroom service is available at CrossFit Best Life. With that being said, the restroom is located within the home of CrossFit Best Life owners, Jared and Paulina McCabe. As a community, we ask that you respect our home as your own and help maintain a clean restroom environment for our facility operations.

All visitors will notice our family dog (Mikko) at a distance using the facility restroom. Mikko will be isolated from the restroom area but you may not be isolated from typical dog noises. You may engage the dog at your own risk.

CrossFit Best Life reserves the right to suspend restroom services or terminate your membership if you show lack of respect for the facility and home of Jared and Paulina McCabe.

Parking

Members must follow the parking pattern available at www.crossfitbestlife.com/parking

Members must be available to move their vehicles if they are a barrier to another member exiting the facility.

Members must exercise caution with exiting onto Route 14 (Milford-Harrington Hwy).
